Smith's mother, April Newkirk, said that the doctors informed the anti-abdominal law of Georgia that her daughter remained life preservation until the fetus could survive outside of the womb.
The law belonged to a wave of anti-abdominal measures that were issued in Republican states after the Supreme Court revoked a constitutional right to abortion care by filling the Landmark Roe V Wing judgment in 2022.
Georgia's law limits abortion as soon as heart activity is determined, or in about six weeks of pregnancy before most women know that they are pregnant. The law also gives a fetus personal rights and effectively provides the same full rights and the same legal protection as a person.
“I don't say that we decided to end their pregnancy. But I say we should have a choice,” Newkirk told 11alive in an earlier interview.
Newkirk felt the same thing after the birth.
“I think all women should have the choice of their bodies,” she said. “And I think I want people to know that.”
