The basis of the Georgia Workers’ Compensation Act (the Act) is to provide injured workers with medical and lost wage benefits in a no-fault system without the rigors of filing a lawsuit and navigating the legal system.
In turn, an injured worker’s legal remedies are limited and, on rare occasions, non-existent; It is the exclusive remedy available to an employer when seeking compensation for injury or even death arising out of or during employment. In exchange for limiting the remedies available to an injured worker, the employer foregoes many of the positive defenses available in traditional tort claims.
