A: It is legal to use pepper spray in self defense when warranted. If used offensively to attack someone, it will likely be considered an attack and/or battery case. In the case of serious bodily harm, it must be proven that the act “probably resulted in death or serious bodily harm”. In the case of mere pepper spray, that could be hard to prove. However, if you are accused of aggravated assault, you should hire an attorney as soon as possible.
