Investigators said the company pays sales managers and event sales consultants a salary plus commission without overtime after working a 40-hour week. They said these employees did not meet regulatory requirements and were entitled to overtime pay. They added that the investigation began after the violations were discovered at the company’s Loudon, Virginia site.

The Department of Labor said company policy is in violation of the Fair Labor Standards Act.

The investigation resulted in 255 employees in 25 states receiving over $ 750,000 in arrears. It comprises four employees at the Alpharetta Top Golf location and seven employees at the Atlanta Midtown location.

TREND STORIES:

“Employers cannot circumvent federal overtime requirements by simply giving an employee the title of manager,” said Betty Campbell, regional administrator for Wage and Hour Southwest. “This case should serve as a clear warning and prompt other employers to review their wage practices. Employers who are unaware of their obligations should contact their local payroll office or visit our website for guidance on how to comply with federal law. “
