The recently enacted Georgian Abortion Law HB 481 may remain in force if a lawsuit is brought against this law. That was the order of a Fulton County Superior Court judge on Monday, a week after the arguments in the case opened.
In their lawsuit on behalf of abortion rights groups and providers, attorneys for the ACLU argue that the abortion law violates the state’s constitutional privacy laws.
HB 481 prohibits abortion after about six weeks of pregnancy, with some exceptions.
The ACLU last week asked Fulton County Superior Court Judge Robert McBurney for an injunction to block the law while the case proceeds.
In his order on Monday, McBurney denied that request.
The ACLU filed its lawsuit in state court after the 11th Circuit Court of Appeals allowed the 2019 Abortion Act to go into effect after the United States Supreme Court ruled that the Roe v. Wade were lifted.
The next hearing date in the state case has not yet been set.
