Georgia Court of Appeals rules Delta-8 is not a controlled substance

The Georgia Court of Appeals ruled that Delta-8, Delta-10 and other hemp-derived cannabinoids are not controlled substances in an opinion released Thursday by Chief Judge Christopher McFadden.

“This is the latest in an ongoing legal battle between the people who believe these hemp products like Delta-8 and Delta-10 are illegal controlled substances and business owners who are looking at the language of the hemp law passed in 2019,” they say “These are legal extracts from hemp. They don’t have the type of delta-9 THC that gets users high, so we are allowed to sell them and have been for four years,” said plaintiff-appellant attorney Thomas Church of Church Law Firm.
