You can file a custody petition with your county high court. If you get divorced, the petition for divorce will be included in your divorce papers. You must then serve or serve custody forms to the other party through a process server or the sheriff’s office.
There are two types of child custody: physical and legal. The child lives with the party with custody. The guardian can make important decisions for the child. When legal or physical custody is shared, one parent or guardian is designated as the primary custodial parent and has the final say in parenting decisions.
Custody applies until the child is 18 years old. If circumstances change and custody needs to be changed, one party can apply for a change of custody. In order to change custody, they must demonstrate that there has been a material change in circumstances that will affect the best interests of the child.
